    NOTICE OF BOND RESOLUTION
    TOWN OF GRAND ISLAND

    NOTICE IS HEREBY GIVEN that a bond resolution, a summary of which is published herewith, has been adopted by the Town Board of the Town of Grand Island, Erie County, New York (the “Town”), on August 2, 2021 and the validity of the obligations authorized by such resolution may be hereafter contested only if:

    1. (a) such obligations were authorized for an object or purpose for which the Town is not authorized to expend money, or
                                                        (b) the provisions of the law which should be complied with as of the date of publication of this notice were not substantially complied with
                                                            and an action, suit or proceeding contesting such validity is commenced within 20 days after the date of such publication of this notice, or
    1. such obligations were authorized in violation of the provisions of the Constitution of New York.

    1. SUMMARY OF BOND RESOLUTION
     
     

    The following is a summary of a bond resolution adopted by the Town Board of the Town of Grand Island on August 2, 2021.  The proceeds from the sale of the obligations authorized in such bond resolution will be used for the purpose of financing the reconstruction of and construction of improvements to various roads within the Town, including all preliminary work and necessary equipment, materials and related site work and all preliminary costs and other improvements and costs incidental thereto and in connection with the financing thereof, as more fully identified in (or contemplated by) a report prepared by the Town Engineering Department (collectively, the “Purpose”), at an estimated maximum amount of $750,000.  Such bond resolution authorizes the issuance and sale of a serial bond or bonds and a bond anticipation note or notes in anticipation of the issuance and sale of such serial bonds, in an aggregate principal amount not to exceed $750,000, such amount to be offset by any federal, state, county and/or local funds received.  Such bond resolution was adopted subject to permissive referendum, and such permissive referendum period has elapsed without the filing of a petition.  The period of probable usefulness for such purpose is five years.  A copy of the bond resolution summarized herein is available for public inspection during normal business hours at the Office of the Town Clerk, located in the Town Hall, 2255 Baseline Road, Grand Island, New York.

                                                PUBLIC HEARING TO BE HELD ON SEPTEMBER 7, 2021

                            WHEREAS, the Town Board of the Town of Grand Island (herein called “Town Board” and “Town”, respectively), in the County of Erie, New York, has, pursuant to Town Law, created the Town of Grand Island Consolidated Water District (the “District”); and

                            WHEREAS, in July of 2021, the Town Board directed Wendel, competent engineers licensed in New York, to prepare a map, plan and report for a water system capital improvements project within the District; and

                            WHEREAS, in July of 2021, the Town approved, through Town Law Section 202-b proceedings and a bond resolution (dated August 2, 2021), a certain capital improvements project in the District; and

                            WHEREAS, the cost of such project increased from $550,000 to $650,000 due to higher than expected bids being received for the project; and

                            WHEREAS, the Town Board has directed Wendel, competent engineers licensed in New York, to prepare a revised map, plan and report (dated August 11, 2021) to reflect the revised cost of the project; and

                            WHEREAS, such revised map, plan and report amends a certain prior map, plan and report (dated July 2021) for the purposes of (a) increasing the estimated maximum cost of the project and (b) increasing the amount of bonds (and notes) for the project; and

                            WHEREAS, the scope of the improvements has not materially changed from the project identified in such original map, plan and report; and

                            WHEREAS, such water system capital improvements project will generally consist of the rehabilitation of the finished water clearwell located at the water treatment plant, such improvements to include, but not be limited to, the preparation of the interior floor of the tank by ultra high water pressure blasting, concrete crack repairs, application of a new interior primer and the application waterproof coating to the interior of the tank, as well as other such improvements as more fully identified in (or contemplated by) such map, plan and report referred to above, all of the forgoing to include all necessary site work, equipment, apparatus and other improvements and costs incidental thereto and in connection with the financing thereof (collectively, the “District Improvement”); and

                            WHEREAS, this amendment (a) increases the cost from $550,000 to $650,000 and (b) increases the aggregate amount of bonds from $550,000 to $650,000; and 

                            WHEREAS, pursuant to the direction of the Town, the Engineer has completed and filed with the Town Board such preliminary map, plan and report (as so amended) for such increase and improvement of facilities of the District and has estimated the total cost thereof to be an increased estimated maximum amount of $650,000; said cost to be financed by the issuance of serial bonds of the Town in an increased aggregate principal amount not to exceed $650,000, offset by any federal, state, county and/or local funds received.

                            WHEREAS, such revised preliminary map, plan and report (hereinafter referred to as map, plan and report) has not been modified in any material respect other than as described above;

      NOW, THEREFORE, BE IT ORDERED that a meeting of the Town Board of the Town of Grand Island will be held at the Town Hall, 2255 Baseline Road, Grand Island, New York, on September 7, 2021 at 8:00p.m. o’clock p.m. (prevailing Time) or shortly thereafter to consider said increase and improvement of facilities of the District and to hear all persons interested in the subject thereof concerning the same and for such other action on the part of the Town Board with relation thereto as may be required by law; and be it

    FURTHER ORDERED, that the expense of said increase and improvement of the facilities shall be financed by the issuance of serial bonds of the Town in an increased aggregate principal amount not to exceed $650,000, said amount to be offset by any federal, state, county and/or local funds received, and, unless paid from other sources or charges, the costs of said increase and improvement of facilities shall be paid by the assessment, levy and collection of special assessments from the several lots and parcels of land within the District, which the Town Board shall determine and specify to be especially benefited thereby, so much upon and from each as shall be in just proportion to the amount of benefit conferred upon the same, to pay the principal of and interest on said bonds as the same shall become due and payable, except as provided by law; and be it

    FURTHER ORDERED, that the Town Clerk publish at least once in each newspaper designated as the official newspaper of the Town for such publication, and post on the sign board of the Town maintained pursuant to subdivision 6 of Section 30 of the Town Law, a copy of this Order, certified by said Town Clerk, the first publication thereof and said posting to be not less than ten nor more than 20 days before the date of such public hearing.

    Notice to Bidders

    All work will be in accordance with the Contract Drawings and Specifications and as directed by the ENGINEER. Separate sealed Bids will be received by the Town of Grand Island until 10:00 a.m. local time on September 29, 2021, at the office of the Town Clerk, Town of Grand Island, 2255 Baseline Road, Grand Island, New York, 14072, and then at that time and place be publicly opened and read aloud.

    All Bids shall be made on the forms furnished and shall be enclosed in a sealed envelope marked "WASTEWATER TREATMENT PLANT DEWATERING IMPROVEMENTS, TOWN JOB NO. M-231, CONTRACT NO. __ (insert applicable number)" and directed to Town of Grand Island.

    Wastewater Treatment Plant Dewatering Improvements, Town Job. No. M231, Contract Nos. 1, 2, and 3.  The work under this Project includes the following: Furnishment and Installation of a Belt Filter Press, Sludge Feed Pumps, Polymer Dosing System, Dewatered Sludge Conveyance System, Interior Process Piping, all with controls and accessories, and all else necessary to furnish a complete project as shown and specified in the Contract Documents.

Bidders acknowledge that they are responsible for review of all components of the Contract Documents, including all specification sections and drawings, regardless of how many drawings they print and in which format/size they are printed.     A pre-bid meeting will be held at 10:00 AM local time on September 16, 2021, at the Town of Grand Island Wastewater Treatment Plant, 3500 Baseline Road, Grand Island, NY 14072. 
    Attendance at the pre-bid meeting is highly encouraged but is not mandatory. 

    The Town of Grand Island is exempt from the payment of sales and compensating use taxes of the State of New York and of cities and counties on all materials, equipment, and supplies sold to the Town of Grand Island pursuant to this Contract. Also exempt from such taxes are purchases by the Contractor and their Subcontractors of materials, equipment, and supplies to be sold to the Town of Grand Island pursuant to this Contract, including tangible personal property to be incorporated in any structure, building, or other real property forming part of the Project. These taxes are not to be included in the Bid.

    Each bid shall be accompanied by cash, certified check, cashier's check, or bid bond in an amount not less than five percent (5%) of the amount of the bid in the form provided,
    and subject to the conditions provided in the Information for Bidders.

    The Successful Bidder will be required to furnish a performance bond and payment bond, each in an amount equal to 100 percent (100%) of the total Contract award amount.

    Each Bidder's attention is called to the General Municipal Law, which requires a Bidder's Certificate of Non‑Collusion.
    Copies of such certifications are part of the Proposal Form, and unless completed with the Bid, will not be accepted.

    The right is reserved to waive any informalities in the Bid and to reject any or all Bids.

    No Bidder may withdraw their Bid within forty‑five (45) calendar days after the actual date of the opening thereof.

    The following is a summary of a bond resolution adopted by the Town Board of the Town of Grand Island (the “Town”) on August 2, 2021.  The proceeds from the sale of the obligations authorized in said bond resolution will be used to finance a water system capital improvements project that will generally consist of the rehabilitation of the finished water clearwell located at the water treatment plant, such improvements to include, but not be limited to, the preparation of the interior floor of the tank by ultra high water pressure blasting, concrete crack repairs, application of a new interior primer and the application waterproof coating to the interior of the tank, as well as other such improvements as more fully identified in (or contemplated by) such map, plan and report prepared in connection with such project, all of the forgoing to include all necessary site work, equipment, apparatus and other improvements and costs incidental thereto and in connection with the financing thereof, at an estimated maximum amount of $550,000.  Said bond resolution authorizes the issuance and sale of a serial bond or bonds and a bond anticipation note or notes in anticipation of the issuance and sale of said serial bonds, in an aggregate principal amount not to exceed $550,000 said amount to be offset by any federal, state, county and/or local funds received.  The period of probable usefulness for said purpose is 40 years.  A copy of the bond resolution summarized herein is available for public inspection during normal business hours at the Office of the Town Clerk, located in the Town Hall, 2255 Baseline Road, Grand Island, New York.

                            WHEREAS, pursuant to the direction of the Town, the Engineer has completed and filed with the Town Board such preliminary map, plan and report for such increase and improvement of facilities of the District and has estimated the total cost thereof to be an estimated maximum amount of $550,000; said cost to be financed by the issuance of serial bonds of the Town in an aggregate principal amount not to exceed $550,000, offset by any federal, state, county and/or local funds received.
                           NOW, THEREFORE, BE IT
    ORDERED that a meeting of the Town Board of the Town of Grand Island will be held at the Town Hall, 2255 Baseline Road, Grand Island, New York, on August 2, 2021 at 8:00p.m. o’clock p.m. (prevailing Time) or shortly thereafter to consider said increase and improvement of facilities of the District and to hear all persons interested in the subject thereof concerning the same and for such other action on the part of the Town Board with relation thereto as may be required by law; and be it
