NOTICE OF PUBLIC HEARING ON

DETAILED PLAN AND AMENDMENT TO THE CONCEPT PLAN SUBMITTED BY ASSOCIATED GRAND ISLAND LLC FOR THE ADULT LIFESTYLE PLANNED UNIT DEVELOPMENT AT SOUTHPOINTE

                        Notice is hereby given that the Town Board of the Town of Grand Island shall hold a public hearing at 8:00 PM on May 2, 2022 at Town Hall, 2255 Baseline Road, Grand Island, New York, 14072, for the purposes of considering the proposed Detailed Plan, based on an Amendment to the Concept Plan for the Adult Lifestyle Planned Unit Development at Southpointe.  The Town Board on October 5, 2020, adopted the Second Revised Development Concept Plan and the Applicant has submitted, and the Planning Board has reviewed the proposed Detailed plan and Amended Concept Plan. The proposal outlined in the approved 2020 Concept Plan included:

1)         (2) – 72 Unit, 6-Story buildings for a total of 164 Units

2)         3- and 4-unit townhomes for a total of 144 units

The Plan has been revised  to instead include:

1)         (2)- 58 Unit 4-Story buildings for a total of 116 Units

2)         3- and 4-unit townhomes for a total of 192 Units

The total number of units remains consistent between the 2020 Concept Plan and the modified 2022 proposal at a total of 308 units for the “Core” area.

As part of the review, the Town Board will consider the following subdivisions

          The work generally consists of the furnishing and delivery of approximately 13,500 lineal feet of new 8, 10, 12, and 16-inch diameter PVC waterlines to the Town of Grand Island.

The Drawings, Specifications and Contract Documents under which the work is to be done are on file and may be examined at the office of Wendel WD Architecture, Engineering, Surveying & Landscape Architecture, P.C., 375 Essjay Road, Suite 200, Williamsville, New York 14221 and at the office of the Town Clerk.

           Copies of the above-mentioned documents may be viewed and ordered through the following website on or after Friday, April 1, 2022: www.avalonplanroom.com in the Public Bid section. Bidders will be charged a non-refundable fee, made payable to Avalon, to receive project documents and be placed on the plan holder list. Shipping and copying will be an additional cost to potential bidders.

          Funding for this project involves a grant through the New York State Drinking Water State Revolving Loan Fund (DWSRF), which is administered by the New York State Environmental Facilities Corporation (NYSEFC).  These grants mandate the fulfillment of NYSEFC requirements relating to MBE/WBE utilization.

A certified check or Bid Bond for a sum not less than five (5) percent of the amount of the Proposal will be required with each Proposal.

The right is reserved by the Town of Grand Island to accept any proposal and to reject any and/or all proposals. No bid may be withdrawn for a period of forty-five (45) days after the above date and time for receiving bids.

Each Proposal must be accompanied by a non-collusive bidding certificate in accordance with Section 103-d of the General Municipal Law.

NOTICE OF PUBLIC HEARING ON THE APPLICATION BY LEGACY DEVELOPMENT AND RIVERTOWN CENTER HOLDINGS, LLC
FOR REZONING TO PLANNED DEVELOPMENT DISTRICT

JANUARY 18, 2022 AT 8:00 PM

PLEASE TAKE NOTICE that the Town Board of the Town of Grand Island (“Town Board”) will hold a public hearing on January 18, 2022 at 8:00 PM on the application of Legacy Development and Rivertown Center Holdings, LLC (collectively “Applicants”) for rezoning to Planned Development District (“Application”) of approximately 25.88 acres of land (SBL: 37.03-1-21.11; 37.03-1-61; 37.03-1-13.111) located at 0 Grand Island Boulevard, between Grand Island Boulevard and Baseline Road, immediately north of Webb Road (“Site”), related to the development and operation of a mixed use development, known as Rivertown Center (“Project”), at the Site.  The Applicants filed the Application on June 29, 2021 and thereafter, the Town Board previously provided opportunity for public comment on the Application at its regularly scheduled meetings held between July 2021 and December 2021.  This public hearing is being held in accordance with the Code of the Town of Grand Island (“Code”) § 407-121(A)(2)(f)(1) following a recommendation from the Town of Grand Island Planning Board for approval of the Application.

Pursuant to Town Code §§ 407-20 and 407-120(C)(2), any request for rezoning to Planned Development District must necessarily include an offer of amenities in exchange for any incentives requested.  Accordingly, the Application, requests certain zoning incentives necessary for the Project and offers amenities in exchange for such incentives.  The incentives required for the Project are described below, followed by a list of amenities offered by the Project.  Both the incentives required for the Project and the amenities offered in exchange for same are discussed in more detail in the Application.

As stated in the Application, the Applicants are requesting the following incentives:

  • Minimum Setback to Common Parking Areas, Code § 407, Attachment 1
    • Required in the R-3 District: 25 feet (front); 10 feet (rear)
    • Incentive Requested: 20 feet (front) for four of eight total market rate apartment buildings; 10 feet (front) for one of eight total market rate apartment buildings; 8 feet (rear) for four of eight total market rate apartment buildings; 5 feet (rear) for one of eight total market rate apartment buildings
    • Percent Deviation from Required: 20% less than is required (front, four buildings); 60% less than is required (front, one building); 20% less than is required (rear, four buildings); 50% less than is required (rear, one building)
  • Minimum Distance Between Buildings on Same Lot, Code § 407, Attachment 1
    • Required in the R-3 District: 60 feet
    • Incentive Requested: 35 feet between market rate apartment buildings; 40 feet between senior apartment building and townhouses; 5 feet between patio homes
    • Percent Deviation from required: 41.7% less distance between market rate apartment buildings than is required; 33.3% less distance between senior apartment building and townhouses than is required; and 91.7% less distance between patio homes than is required

    • Required in the R-3 District: 160 feet

Project Description:

The Department has received an application for the replacement of 12,800 linear feet of waterline along Baseline Road. No new water line will be installed as part of this project and all disturbance will be confined to the exiting right-of-way. A small portion of the work will cross within the regulated 100-foot-wide adjacent area of New York State Freshwater Wetland TW-15. The project is located on Baseline Road from Bush Road to Alvin Road in the Town of Grand Island. The project meets the Department’s Part 663 compatibility and weighing standards. The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance.
